Oversight Committee
While the Major Organised Crime and Anti-Corruption Agency is operationally independent and autonomous, it is subject to the oversight of an independent Committee as defined and articulated in Sections 10 and 32 of the Major Organised Crime and Anti-Corruption Agency Act as the Oversight Committee.
Under the Act, the main functions of the Oversight Committee include:
a) Holding the Director-General and other officers of the Agency accountable to the public in the performance of their functions; and
b) Providing independent oversight in relation to the handling of complaints made to the Agency.
The functions of the committee as set out in section 33 of the legislation include investigating complaints relating to misconduct; monitoring operations affecting members of the public, and reviewing the performance of the Agency.
The Oversight Committee, therefore ensures that MOCA consistently maintains its professional standards through systems of accountability and transparency in delivering high-quality operational outcomes.
The Committee Members
The members of the Oversight Committee and its Chairman are appointed for a three-year term by the Governor General, upon recommendation received by the Prime Minister after consultation with the Leader of the Opposition. Each member of the Oversight Committee is subjected to a rigorous vetting process in order to ensure not only the Committee’s integrity, but also that of the Agency.
The Committee shall consist of the following persons appointed as members by the Governor-General, to serve for a period not exceeding three years, upon recommendations received by the
Prime Minister after consultation with the Leader of the Opposition-

a retired Judge of the Supreme Court;

a retired officer of the Jamaica Constabulary Force not below the rank of Assistant Commissioner of Police;

a retired officer of the Jamaica Defence Force not below the rank of Colonel;
-
two other members nominated by the Minister responsible for national security with expertise in any one, or more of the following areas-
(i) financial sector;
(ii) anti-corruption;
(iii) public procurement.
